Amennyiben a V\u00e1s\u00e1rl\u00f3 aj\u00e1nlata 48 \u00f3r\u00e1n bel\u00fcl nem ker\u00fcl visszaigazol\u00e1sra, az aj\u00e1nlati k\u00f6t\u00f6tts\u00e9g megsz\u0171nik. A Szerz\u0151d\u00e9s a Szolg\u00e1ltat\u00f3 \u00e1ltal e-mailben megk\u00fcld\u00f6tt rendel\u00e9sr\u0151l sz\u00f3l\u00f3 visszaigazol\u00e1s\u00e1val j\u00f6n l\u00e9tre.<\/p><p>A Szolg\u00e1ltat\u00f3 kiz\u00e1r\u00f3lag 18 \u00e9ven fel\u00fcli szem\u00e9lyek r\u00e9sz\u00e9re \u00e9rt\u00e9kes\u00edt Alkoholos Term\u00e9ket, erre tekintettel a V\u00e1s\u00e1rl\u00f3 az \u00c1SZF elfogad\u00e1s\u00e1val kijelenti, hogy a Szerz\u0151d\u00e9s megk\u00f6t\u00e9skor a 18. \u00e9let\u00e9v\u00e9t bet\u00f6lt\u00f6tte.<\/p><p>A Term\u00e9kek l\u00e9nyeges tulajdons\u00e1gait, jellemz\u0151it a konkr\u00e9t Term\u00e9k oldal\u00e1n lehet megismerni.<\/p><p>A Szolg\u00e1ltat\u00f3 \u00e9s a V\u00e1s\u00e1rl\u00f3 k\u00f6z\u00f6tt l\u00e9trej\u00f6v\u0151 szerz\u0151d\u00e9s tartalm\u00e1t a jelen \u00c1SZF hat\u00e1rozza meg. A Szerz\u0151d\u00e9s nem min\u0151s\u00fcl \u00edr\u00e1sba foglalt szerz\u0151d\u00e9snek, azt az Elad\u00f3 nem iktatja.<\/p><p>A Szerz\u0151d\u00e9s a magyar jog hat\u00e1lya al\u00e1 tartozik, \u00e9s a Szerz\u0151d\u00e9sb\u0151l ered\u0151 b\u00e1rmilyen jogvita elb\u00edr\u00e1l\u00e1s\u00e1ra a magyar b\u00edr\u00f3s\u00e1gok kiz\u00e1r\u00f3lagos joghat\u00f3s\u00e1ggal b\u00edrnak.<\/p><p>Az \u00e1rak forintban \u00e9rtend\u0151k, a 27%-os \u00c1F\u00c1-t tartalmazz\u00e1k, a sz\u00e1ll\u00edt\u00e1si k\u00f6lts\u00e9geket nem. A Szerz\u0151d\u00e9s megk\u00f6t\u00e9s\u00e9vel a V\u00e1s\u00e1rl\u00f3 a sz\u00e1ll\u00edt\u00e1si k\u00f6lts\u00e9gek visel\u00e9s\u00e9t is v\u00e1llalja. Az \u00e1rak t\u00e1j\u00e9koztat\u00f3 jelleg\u0171ek, az \u00e1rv\u00e1ltoz\u00e1s jog\u00e1t a Szolg\u00e1ltat\u00f3 fenntartja.<\/p><p>A Szolg\u00e1ltat\u00f3 fenntartja a jogot, hogy a rendel\u00e9s visszaigazol\u00e1s\u00e1ban esetlegesen t\u00e9vesen szerepl\u0151 \u00e1rat, illetve egy\u00e9b param\u00e9tert a hiba \u00e9szlel\u00e9s\u00e9t k\u00f6vet\u0151en kijav\u00edtsa, amelyr\u0151l a korrig\u00e1l\u00e1st k\u00f6vet\u0151en a Szolg\u00e1ltat\u00f3 halad\u00e9ktalanul \u00e9rtes\u00edti a Fogyaszt\u00f3t. Ebben az esetben a V\u00e1s\u00e1rl\u00f3 elfogadhatja a m\u00f3dos\u00edtott felt\u00e9teleket vagy minden tov\u00e1bbi k\u00f6vetkezm\u00e9ny n\u00e9lk\u00fcl el\u00e1llhat a Szerz\u0151d\u00e9st\u0151l.<\/p><p>A Szolg\u00e1ltat\u00f3 a Term\u00e9k v\u00e9tel\u00e1r\u00e1nak kiegyenl\u00edt\u00e9s\u00e9ig a Term\u00e9k feletti tulajdonjog\u00e1t fenntartja, a k\u00e1rvesz\u00e9ly azonban a Term\u00e9k \u00e1tad\u00e1s\u00e1val \u00e1tsz\u00e1ll a V\u00e1s\u00e1rl\u00f3ra.<\/p><p><strong>Term\u00e9k kisz\u00e1ll\u00edt\u00e1sa \u00e9s \u00e1tv\u00e9tele<\/strong><\/p><p>A Term\u00e9ket a Szolg\u00e1ltat\u00f3 k\u00f6zrem\u0171k\u00f6d\u0151 fut\u00e1rszolg\u00e1lattal juttatja el a V\u00e1s\u00e1rl\u00f3 \u00e1ltal meghat\u00e1rozott \u00e1tveteli helyre. A Term\u00e9k \u00e1tad\u00e1s\u00e1nak helye az a f\u00f6ldrajzi hely, amelyet a web\u00e1ruh\u00e1z fel\u00fclete \u00e1ltal felaj\u00e1nlott lehet\u0151s\u00e9gek keretei k\u00f6z\u00f6tt a V\u00e1s\u00e1rl\u00f3 meghat\u00e1roz.<\/p><p>A jelen \u00c1SZF elt\u00e9r\u0151 rendelkez\u00e9se hi\u00e1ny\u00e1ban az Elad\u00f3 Magyarorsz\u00e1g ter\u00fclet\u00e9n biztos\u00edtja a megrendelt term\u00e9kek kisz\u00e1ll\u00edt\u00e1s\u00e1t. A Magyarorsz\u00e1gon k\u00edv\u00fcli v\u00e1s\u00e1rl\u00e1s eset\u00e9n a teljes\u00edt\u00e9se tekintet\u00e9ben egyedi meg\u00e1llapod\u00e1s sz\u00fcks\u00e9ges a Szolg\u00e1ltat\u00f3 \u00e9s a V\u00e1s\u00e1rl\u00f3 k\u00f6z\u00f6tt.<\/p><p>Amennyiben a Term\u00e9kek k\u00f6z\u00f6tt Alkoholos Term\u00e9k is van, a fut\u00e1r meggy\u0151z\u0151dik arr\u00f3l, hogy az \u00e1tvev\u0151 szem\u00e9ly elm\u00falt 18 \u00e9ves. Amennyiben az \u00e1tvev\u0151 az \u00e9letkor\u00e1t hat\u00f3s\u00e1gi igazolv\u00e1nnyal nem igazolja, a fut\u00e1rszolg\u00e1lat megtagadja a k\u00e9zbes\u00edt\u00e9st \u00e9s a Term\u00e9ket a felad\u00e1s hely\u00e9re viszi vissza. Ebben az esetben a felmer\u00fcl\u0151 t\u00f6bbletk\u00f6lts\u00e9gek a V\u00e1s\u00e1rl\u00f3t terhelik.<\/p><p>A Term\u00e9kek \u00e1tv\u00e9telekor a V\u00e1s\u00e1rl\u00f3 k\u00f6teles a Term\u00e9kek s\u00e9rtetlens\u00e9g\u00e9r\u0151l, tov\u00e1bb\u00e1 mennyis\u00e9gi \u00e9s min\u0151s\u00e9gi megfelel\u0151s\u00e9g\u00e9r\u0151l meggy\u0151z\u0151dni. Amennyiben esetleg s\u00e9r\u00fcl\u00e9st vagy hi\u00e1nyt tapasztal a V\u00e1s\u00e1rl\u00f3, azt k\u00f6teles jelezni a fut\u00e1r r\u00e9sz\u00e9re \u00e9s minden k\u00f6teles hivatalos jegyz\u0151k\u00f6nyv felv\u00e9tel\u00e9t k\u00e9rni. Hivatalos jegyz\u0151k\u00f6nyv hi\u00e1ny\u00e1ban az esetleges hi\u00e1ny\u00e9rt vagy s\u00e9r\u00fcl\u00e9s\u00e9rt ut\u00f3lagosan felel\u0151ss\u00e9get nem v\u00e1llal a Szolg\u00e1ltat\u00f3, amennyiben nem bizony\u00edthat\u00f3, hogy az m\u00e1r a felad\u00e1skor l\u00e9tezett.<\/p><p>Amennyiben a szolg\u00e1ltat\u00e1st megb\u00edzott fut\u00e1rszolg\u00e1lat hib\u00e1j\u00e1b\u00f3l nem vagy k\u00e9sve teljes\u00fcl, ezzel kapcsolatos k\u00e1r\u00e9rt a Szolg\u00e1ltat\u00f3 nem felel.\u00a0<\/p><p><strong>Fogyaszt\u00f3i t\u00e1j\u00e9koztat\u00f3 a 45\/2014. (II. 26.) Korm. rendelet alapj\u00e1n<\/strong><\/p><p>A Ptk. 8:1. \u00a7 1. bekezd\u00e9s 3. pontja szerint csak a szakm\u00e1ja, \u00f6n\u00e1ll\u00f3 foglalkoz\u00e1sa vagy \u00fczleti tev\u00e9kenys\u00e9ge k\u00f6r\u00e9n k\u00edv\u00fcl elj\u00e1r\u00f3 term\u00e9szetes szem\u00e9ly min\u0151s\u00fcl fogyaszt\u00f3nak, \u00edgy jogi szem\u00e9lyek nem \u00e9lhetnek az indokol\u00e1s n\u00e9lk\u00fcli el\u00e1ll\u00e1si joggal.<\/p><p>A fogyaszt\u00f3 az el\u00e1ll\u00e1si jog\u00e1t a) term\u00e9k ad\u00e1sv\u00e9tel\u00e9re ir\u00e1nyul\u00f3 szerz\u0151d\u00e9s eset\u00e9n aa) a term\u00e9knek, ab) t\u00f6bb term\u00e9k ad\u00e1sv\u00e9telekor, ha az egyes term\u00e9kek szolg\u00e1ltat\u00e1sa elt\u00e9r\u0151 id\u0151pontban t\u00f6rt\u00e9nik, az utolj\u00e1ra szolg\u00e1ltatott term\u00e9knek, a fogyaszt\u00f3 vagy az \u00e1ltala megjel\u00f6lt, a fuvaroz\u00f3t\u00f3l elt\u00e9r\u0151 harmadik szem\u00e9ly \u00e1ltali \u00e1tv\u00e9tel\u00e9nek napj\u00e1t\u00f3l sz\u00e1m\u00edtott 14 napos hat\u00e1rid\u0151n bel\u00fcl gyakorolhatja.<\/p><p>A jelen pontban foglaltak nem \u00e9rintik a fogyaszt\u00f3 azon jog\u00e1t, hogy az e pontban meghat\u00e1rozott el\u00e1ll\u00e1si jog\u00e1t a szerz\u0151d\u00e9s megk\u00f6t\u00e9s\u00e9nek napja \u00e9s a term\u00e9k \u00e1tv\u00e9tel\u00e9nek napja k\u00f6z\u00f6tti id\u0151szakban is gyakorolja. Ha a szerz\u0151d\u00e9s megk\u00f6t\u00e9s\u00e9re a fogyaszt\u00f3 tett aj\u00e1nlatot, a fogyaszt\u00f3t a szerz\u0151d\u00e9s megk\u00f6t\u00e9se el\u0151tt megilleti az aj\u00e1nlat visszavon\u00e1s\u00e1nak joga, ami a szerz\u0151d\u00e9s megk\u00f6t\u00e9s\u00e9re kiterjed\u0151 aj\u00e1nlati k\u00f6t\u00f6tts\u00e9get megsz\u00fcnteti.<\/p><p>A fogyaszt\u00f3 a 45\/2014. (II. 26.) Korm. rendelet 20. \u00a7-ban biztos\u00edtott jog\u00e1t az erre vonatkoz\u00f3 egy\u00e9rtelm\u0171 nyilatkozat \u00fatj\u00e1n, vagy az\u00a0<a href=\"http:\/\/fogyasztovedelem.kormany.hu\/sites\/default\/files\/elallasi_felmondasi_nyilatkozatminta.doc\">itt<\/a>\u00a0el\u00e9rhet\u0151 nyilatkozat-minta felhaszn\u00e1l\u00e1s\u00e1val gyakorolhatja. Az el\u00e1ll\u00e1si jogot hat\u00e1rid\u0151ben \u00e9rv\u00e9nyes\u00edtettnek kell tekinteni, ha a fogyaszt\u00f3 nyilatkozat\u00e1t hat\u00e1rid\u0151n bel\u00fcl elk\u00fcldi.\u00a0<\/p><p>Ha a fogyaszt\u00f3 a 45\/2014. (II. 26.) Korm. rendelet 22. \u00a7-nak megfelel\u0151en el\u00e1ll a szerz\u0151d\u00e9st\u0151l, k\u00f6teles a term\u00e9ket halad\u00e9ktalanul, de legk\u00e9s\u0151bb az el\u00e1ll\u00e1s k\u00f6zl\u00e9s\u00e9t\u0151l sz\u00e1m\u00edtott tizenn\u00e9gy napon bel\u00fcl visszak\u00fcldeni, illetve az Elad\u00f3nak vagy az Elad\u00f3 \u00e1ltal a term\u00e9k \u00e1tv\u00e9tel\u00e9re meghatalmazott szem\u00e9lynek \u00e1tadni.
